Agreement to Terms
By engaging Pacific Sky Aerials ("Company," "we," "us," or "our") for drone services, you agree to these Terms of Service. Please read them carefully before booking our services.
Services
Pacific Sky Aerials provides professional aerial photography and videography services using unmanned aerial vehicles (drones). Our services include but are not limited to real estate photography, construction documentation, tourism and winery marketing, and inspections.
Booking and Payment
- A 50% deposit is required to secure your booking date.
- The remaining balance is due upon delivery of final files.
- Accepted payment methods include e-transfer, credit card, and cheque.
- All prices are in Canadian dollars (CAD) unless otherwise specified.
- Quotes are valid for 30 days from the date of issue.
Cancellation Policy
- Cancellations made more than 7 days before the scheduled shoot: Full refund of deposit.
- Cancellations made within 7 days: 50% of deposit refunded.
- Cancellations made within 24 hours: No refund.
- Weather-related cancellations will be rescheduled at no additional cost.
- If we must cancel due to unforeseen circumstances, a full refund will be provided.
Weather and Safety
Safety is our top priority. We reserve the right to postpone or cancel flights due to:
- Adverse weather conditions (rain, snow, high winds, poor visibility)
- Air traffic restrictions or temporary flight restrictions
- Equipment malfunction or safety concerns
- Any other conditions that may compromise flight safety
Licensing and Permissions
Upon full payment, clients receive a perpetual, non-exclusive license to use the delivered content for its intended purpose. Pacific Sky Aerials retains copyright and may use footage for portfolio, marketing, and promotional purposes unless otherwise agreed in writing.
Client Responsibilities
The client agrees to:
- Obtain necessary permissions for drone operations on private property
- Provide accurate information about the project location and requirements
- Ensure the shoot location is accessible and safe
- Be present or have an authorized representative on-site during the shoot
- Notify us of any hazards, obstacles, or restrictions at the location
Liability
Pacific Sky Aerials operates in compliance with all Transport Canada regulations. However, we are not liable for:
- Delays or cancellations due to weather or circumstances beyond our control
- Results that do not meet subjective expectations if technical specifications are met
- Third-party claims arising from client's use of the delivered content
- Loss of business or indirect damages
Delivery
- Standard delivery is 3-5 business days after the shoot.
- Rush delivery (24-48 hours) is available for an additional fee.
- Files are delivered digitally via secure download link.
- Raw footage is available upon request for an additional fee.
- We retain backup copies of all content for 90 days after delivery.
Revisions
Our standard packages include one round of minor revisions (color grading adjustments, minor edits). Additional revisions or significant re-editing may incur additional fees.
Dispute Resolution
Any disputes arising from these terms will be resolved through good-faith negotiation. If a resolution cannot be reached, disputes will be subject to the laws of British Columbia, Canada, and the exclusive jurisdiction of the courts of British Columbia.
Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be posted on our website and will apply to services booked after the effective date.
